Docket 7466-State Sanctioned Information

Pursuant to the March 9, 2010 Public Service Board (Board) “Order Regarding Process and Evaluation Criteria for Initial Overall Performance Assessment” in Docket 7466, the Department of Public Service (Department) provides “state-sanctioned” information for consideration in the Board’s Overall Performance Assessment of Vermont Energy Investment Corporation (VEIC) and Burlington Electric Department (BED).  As noted by the Board in their Order, “‘State-sanctioned information’ includes information previously developed by the Board or DPS that may be useful in evaluating the performance Energy Efficiency Utility (EEU).” In order to allow easy access to the multitude of documents collected, the Department has created this website (referred to herein as “the website” where this information can be found.  Please contact the Department of Public Service directly for hard copies of any of the online documents. 

Each type of information listed below is briefly described.  The Department offers no recommendation on any of the materials provided herein, and provides them without prejudice for interested stakeholders to consider.

Public Service Board Orders

A number of Public Service Board Orders are particularly relevant in that they provide policy guidance to which Efficiency Vermont and Burlington Electric Department respond.  Some important Orders are provided here related to the initial approval of the EEU Structure in Docket 5980, Geotargeting, and participation in the Forward Capacity Market.  Other relevant Orders, such as the Order in Docket 7081 approving the Memorandum of Understanding between parties to that docket, can be found through the search engine of the Board website.

Contracts between the Public Service Board and Vermont Energy Investment Corporation

The Board has conducted multiple competitive solicitations for entities to serve as the EEU, and held multiple contracts with VEIC.  These documents contain information regarding scope of services, compensation provisions, performance incentives, and other general responsibilities for the relevant performance periods.  These documents are readily available on the Board’s website at: http://psb.vermont.gov/projects/EEU/rfpsandcontracts

Appointment of BED to provide Energy Efficiency Services in its service territory

The 9/22/2000 Board “Order Re: Approval of City of Burlington Electric Department’s Proposal to Implement Core Programs Within its Service Territory” appointed BED to provide energy efficiency services coordinated with the statewide EEU.  It authorizes budgets for 2001 and 2002.  The Department/BED Bilateral Agreement outlines the initial scope of activities for BED’s efficiency services. The Budget and Savings Plans for the 2003-2005 are provided below.  In 2005, BED requested to continue providing efficiency services in their territory, the request and 2006-2008 Plan and budgets are provided.    BED’s plans and budgets for the following year can also be found in the annual reports provided further below.  Copies of BED’s “Plan for Delivering Statewide Core Energy Efficiency Programs to Burlington Customers” submitted to the Board in November of 1999 are available upon request.

Efficiency Vermont Annual Reports
As required by the contract between the Public Service Board and Efficiency Vermont, Efficiency Vermont is required to submit Annual Reports that include a report on actual expenditures (administrative, information technology, and service delivery), incentive payments, and annual verified savings data.  The reports also include information on the degree of leveraging (customer contributions and grant funds) achieved by the contractor.

Burlington Electric Department DSM Annual Reports
Burlington Electric Department also issues an annual report summarizing the implementation of energy efficiency programs in their territory.  Annual Reports from 2004-2008 are provided.  Annual Report information for years prior to 2004 are not in a convenient electronic format.  Please contact the Department directly to request copies of this older information. 

Department of Public Service Annual Verification of Efficiency Vermont Savings Claims
The Department of Public Service has annually conducted a review intended to identify any errors in calculation, assumptions, and methodology made by Efficiency Vermont in regards to claimed MWh, Summer and Winter MW, and Total Resource Benefit savings. The Department presents its report to the Contract Administrator, who makes a recommendation to the Board for approval.  Department reports are provided for 2000-2008 savings claims.

Contract Administrator Recommendation to the Public Service Board regarding Annual Savings
The Contract Administrator provides a recommendation to the Board regarding annual energy and TRB savings that should be approved by the Board.  These recommendations also highlight the level of agreement between EVT and the Department on the Department’s report, and recommends resolution if necessary.  Recommendations from 2005-2008 are provided, please contact the Department for older recommendations.  Supporting documentation originally provided with all recommendations is also available upon request.

Public Service Board Determination of Savings for VEIC
Following receipt of the Contract Administrator’s recommendation, the Board makes a determination regarding the annual electrical savings, total resource benefits and annual peak demand savings that will be credited toward VEIC’s total contractual goals. The determination is made in a letter to VEIC; at the end of three year performance periods the letters regarding this determination and in regards to performance incentive awards are one in the same, thus there are no letters for 2002, 2005, and 2008.  The determination made in these letters is reflected in the annual reports.

Following each performance period, the Board issues letters notifying VEIC of its determinations in regards to VEIC’s performance and the amount of incentive award earned.  Each of the letters, for 2002, 2005, and 2008, are provided.

In addition, the Department provides a document that was originally provided by VEIC as Exhibit BH-2 of VEIC’s Direct Testimony in Docket 7466.  This excel spreadsheet provides a summary of the performance goals (as described in the contracts) and performance relative to those targets.  The Department has made a few minor modifications to the original document based on the performance award letters and determinations of savings.  The contents of the spreadsheet are verified for performance cycles 2003-2005 and 2006-2008.

The Department has conducted verification of savings claimed by BED most recently for program year 2006.  Please contact the Department directly for older reports. 

Independent Audit
30 VSA §209(e)(12) requires that an independent audit of the energy and capacity savings claims and cost-effectiveness of the EEU be conducted on a triennial basis. These audits were completed in 2002, 2005, and 2008.

Financial Audit of VEIC
The financial position of Vermont Energy Investment Corporation and the related statements of activities and change in net assets, and cash flows is audited annually.  Note that this audit reviews the entire VEIC organization, not just Efficiency Vermont Activities. 2005-2008 audits are provided.  Please contact the DPS directly for older reports.

Energy Efficiency Utility Fund Audit
The financial position of the Vermont Energy Efficiency Utility Fund, and the related statements of revenues, expenditures and changes in net assets and cash flows for the years then ended is independently audited annually.  The audits for 2005-2008 are provided.  Please contact the DPS directly for copies of older audits.

Public Service Board Reports to the Legislature
30 V.S.A. §209(d)(3) requires the Board to provide the legislature with an annual report “detailing the revenues collected and the expenditures made for energy efficiency programs”.   Reports for 2007-2010 are provided.  Please contact the DPS directly for older reports.

Department of Public Service Market Assessments and other Evaluations
